We are two weeks into the 2023 legislative session here in Jeff City. And while our primary goal is defending SAPA law, we’re also pushing legislation to enhance our Stand-Your-Ground law!
To be clear, Missouri does have Stand-Your-Ground law.
But our current laws are weak because they start with the presumption that we are guilty of a crime in the wake of a self-defense shooting — giving all the power to local prosecutors.
This is America; we’re supposed to be innocent until proven guilty. And in dozens of other states where they have enhanced Stand-Your-Ground law, gun owners are. But not here.
The legislation that we’ve had filed with Senator Rick Brattin and Representative Ben Baker would bring that presumption of innocence to gun owners in Missouri!

Another problem with our self-defense laws is the fact that we can not invoke Stand-Your-Ground law as a defense in court unless it’s on an appeal after a Soros-funded prosecutor has ruined our lives!
This is madness.
Gun owners like Kyle Rittenhouse and Mark McCloskey had their lives forever altered by woke prosecutors who were hell-bent on convicting them to score political points, not justice.
That’s why MOFC’s legislation establishes a process that allows gun owners to assert our Stand-Your-Ground protections in a pre-trial motion! If you win, the case is over before it begins!
This is how it should be. The state shouldn’t be able to simply wait you out using their unlimited resources, and force you to plead guilty because you can’t afford your legal fees.

Unfortunately, these are not the only issues with Missouri’s self defense laws.
In many other states, gun owners may not be arrested in the wake of a self-defense situation unless there is probable cause that a crime has been committed — but that’s not the case here!
This means that after you are attacked on the street by a violent criminal who forces you to defend yourself, you will be attacked again, by a vengeful prosecutor who will order your arrest ‘just because.’
This happens all the time. And it gives liberal prosecutors the power to hold you in jail, interrogate you, and force you to plead guilty to a lesser charge in many cases! This is wrong!
Our legislation fixes that, too. Gun owners MAY NOT be arrested following a shooting unless there is probable cause that they broke the law.

Finally, our legislation would protect gun owners who threaten to use force to stop a criminal but don’t have to actually pull the trigger, provided that that action was justifiable.
Kim Gardner came after Mark McCloskey not because he shot anyone — he didn’t — but because he ‘assaulted’ a mob by pointing a weapon at them. Of course he did, and he was 100% justified! But because of Missouri laws, that was a criminal offense!
This is ridiculous.
The goal of every gun owner who is forced to pull his firearm when confronted by a violent criminal is that the thug will turn around and run away. No one WANTS to pull that trigger.
But the law doesn’t support that kind of restraint here in Missouri. You’re damned if you do shoot, and damned if you don’t. Our legislation will fix this, too.
As you can see, there are a lot of holes in Missouri’s self-defense laws. And with George Soros single-handedly electing county prosecutors all over the country, this is a recipe for disaster!

Just because this legislation makes perfect sense to you and me, doesn’t mean that it will simply pass into law here in the legislature without a fight!
On the contrary, MOFC members are going to have to push hard to make sure that leadership in the House and Senate put this bill into motion.

Don’t forget, dozens of other states have already put similar legislation into law, protecting gun owners from prosecutors who are pushing a political agenda versus pursuing justice.
It’s high time that Missouri does the same thing.
