By national standards, Missouri has some fairly impressive gun laws. We have a strong ‘shall issue’ carry permit complete with a lifetime permit, and that’s in addition to our Constitutional Carry and Stand-Your-Ground laws.
Moreover, we’ve crushed every gun control bill that has been filed by radical socialists in Jeff City since we were formed back in 2015.
But with Joe Biden in the White House now, all that we have worked so hard for could disappear overnight through a combination of legislation and executive actions that are designed to cripple our great Second Amendment forever!
And that’s why it’s vital that the Missouri legislature pass the Second Amendment Preservation Act (SAPA) which is currently making its way through the process in Jeff City.
As you know, this legislation (S.B. 39/H.B. 85) would nullify federal gun control laws, executive orders, and treaties by stating very clearly that Missouri peace officers may only enforce Missouri laws where our gun rights are concerned.
Far from a pipe-dream, SAPA legislation is based on the anti-commandeering doctrine which has been upheld by the Supreme Court for hundreds of years by liberal and conservative justices alike and ensures that the federal government can’t simply force their will upon the states.

In other words, the State of Missouri can decide to stop enforcing federal laws that don’t align with our state laws, much in the same way that some states have legalized marijuana while the federal government still outlaws it.
But first, we need to pass the bill.
The idea of nullifying federal gun control isn’t new. When President Obama got into office, everyone was talking about the ‘Firearms Freedom Act’ as a way to stop his war against gun owners.
But this old legislation had a major flaw, however, in that it required the State Attorney General to defend a gun owner whose gun rights were being violated by government officials.
As we all know, trusting any Attorney General to stand in the gap for gun owners is just wishful thinking. Republican or Democrat, putting our security into their hands would be extremely risky.
Our SAPA legislation is much different. The bill that Senator Burlison and Representative Taylor have sponsored in Jeff City allows individual gun owners to bring government officials who violate SAPA law (and their gun rights) to civil court on their own initiative to seek relief.
Doing this not only gives our SAPA legislation real teeth, it also protects Missouri’s peace officers in a very real way.
You see, we are already hearing from troopers, deputies, and city cops who are concerned about being ordered to enforce gun control — which would force them to violate their oath to the Constitution or lose their job.
SAPA legislation protects Missouri’s peace officers from having to choose between enforcing unconstitutional federal gun control laws or losing their job, by allowing them to point to SAPA law and remind their departments that enforcing Biden’s gun control agenda would be a crime!
Simply put: SAPA legislation is our fallback point if Joe Biden is somehow able to pass federal gun control. It protects gun owners, peace officers, and the Second Amendment.
But for us to do this, we need EVERY self-described pro-gun politician in Jeff City to co-sponsor and actively champion this bill.
It would be nice to assume that our massive pro-gun majorities would make passage of this legislation a mere formality, but we know differently.
The truth is that the legislature hasn’t passed a pro-gun bill since President Obama was in the White House, so it’s obvious that we need to flood the Capitol with grassroots pressure!
