Breaking: Legislation Filed to ‘Fix’ SAPA Law!

Recently we told you that Missouri AG Andrew Bailey has filed an appeal with the United States Supreme Court over the 8th Circuit’s decision to strike down the Second Amendment Preservation Act.

But MOFC is going to address this issue from two directions.

While we wait to see if the Court will take up the case, we’re also going full speed ahead with a revision of SAPA law.

You see, the 8th Circuit didn’t mind that SAPA told the feds they couldn’t use our cops to enforce federal gun control laws. And they didn’t mind the civil penalties in the law, either.

Their issue (not that we agreed with them) was in the law’s preamble. In there, they said they found supremacy clause violations.

So while we fight to uphold SAPA law in the Supreme Court, we’ve also just filed an modified version of SAPA that effectively contains all the things we need, while removing the unnecessary preamble.

Senate Bill 23 would:

  1. Tell the federal government that they can not use Missouri cops to enforce federal gun control laws or executive orders.
  2. Allow Missourians to sue agencies that violate SAPA law in civil court for damages that start at $50,000.
  3. Bar the feds from bypassing SAPA by using Missouri cops in federal task forces to infringe on our gun rights.
